Land (land plot) privatize in Kyiv or the region
One of the most widely used and simple ways of acquiring land ownership has become the procedure for the privatization of land by its owners in whole or in part if it exceeds the minimum established by law.
Land privatization is the acquisition of land as a valuable asset that was state or communal property, in full private ownership – with the right to use it for its intended purpose, receive income, lease, sell, pledge. Land in private ownership is the subject of transactions for alienation, exchange, donation, mortgage. It increases the value of the properties located on it and is inherited.
Article 116 of the Land Code of Ukraine provides for the right of every citizen of Ukraine to receive a certain area of state land free of charge. However, there are some conditions and restrictions for the procedure of land privatization. Documents for land privatization
Documents required for land privatization in Kyiv or Kyiv region:
- passport and customer code;
- permission of the village, settlement, city council or district state administration;
- coordinated copying from the master plan for development;
- documents for buildings, if any, are located on the site (title of ownership, technical passport);
- certificate of the address of the location of the land;
- an act on the coordination of borders (if there are neighbors);
- geodetic survey and geodetic report;
- land management project for the allotment of a land plot;
- copies of contracts for the sale of land and buildings;
- conclusions about expert and regulatory monetary valuations (for the previous owner);
- conclusion from the management of land resources about the restriction on the plot (for the previous owner).
Privatization procedure
The procedure for privatizing land include:
Submission of an application for privatization to a local self-government body (village, settlement council, city council or district state administration). Depends on the location of the land.
A decision is being made to privatize the land. Permission is granted to develop documentation on land management.
There is a departure of surveyors, they produce technical documentation for the land plot, the act of privatization is being drawn up. Surveyors take measurements of the site with the definition of boundaries and coordinates, a cadastral plan is drawn up.
Submission of documentation on land management to the local council or district state administration, obtaining a decision on the transfer of ownership of the site.
Submission of a package of documents to the registrar, registration of a land plot and obtaining an Extract from the Register of real rights to real estate.
